Business Geographics Terms of Service

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR USING ANY OF THE CONTENT AVAILABLE IN THE BUSINESS GEOGRAPHICS PORTAL INCLUDING QIKMAPS, QIKREPORTS, DATA DASHBOARDS AND ASSOCIATED CONTENT. YOU AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THIS WEBSITE.

Subject to the terms of this Agreement and payment by the Licensee of the Subscription Fee, Business Geographics grants to the Licensee a limited, non-exclusive, non-transferable licence to access the Business Geographics Portal and any associated content, for its internal business purposes, for the duration of the subscription term only, in accordance with the licence limitations set out in this Agreement.

General Conditions of Use

The website is only to be used by the number of users specified and any password/ID issued by Business Geographics to a user is personal and confidential to that user. The Licensee shall implement reasonable controls to ensure that it does not exceed the number of users. If the Licensee exceeds the total number of users allowed, the Licensee will be in breach of this Agreement. Business Geographics may limit the number of devices that may be signed in to an account at any time to minimise the risk of account sharing.

This Licence is granted only to the Licensee. The Licensee must not make the website available in any medium or manner to any third party (including the Licensee's Related Parties and Subsidiaries). The Licensee must not distribute, transfer, resell, assign, rent, lease or sub-license any of the Licensee's rights under this Licence without Business Geographics' prior written consent. The Licensee must not redistribute, copy, publish, sell, alter, modify, tamper with, reverse engineer, decompile, or disassemble any content generated on the Business Geographics Portal.

The Licensee may make the website available to any employee or contractor, subject to that person complying with the terms of the Agreement as if they were a party to it. The Licensee is responsible and liable for any person that uses the Licensee's account access details or uses the website made available to the Licensee in breach of this Agreement.

This Agreement does not transfer to the Customer any intellectual property rights in the Business Geographics Portal, and any associated content, and the Customer must not represent that it owns those rights.

If the Licensee breaches this agreement, Business Geographics reserves its rights to terminate the Agreement, restrict the Licensee's access to the website and/or take any other steps available to it at law.

Delivery & Security of Information

Business Geographics will make all reasonable efforts to ensure the service remains operational. However, certain technical difficulties or maintenance may result in service interruptions.

Business Geographics will take such steps as reasonable to protect information from misuse, interference, loss, unauthorized access, modification and disclosure but does not make any representation or give any warranty as to the security of information. The Licensee shall have a password policy in place which reasonably ensures that its employee passwords meet or exceed industry standard password strength requirements.

Accuracy of Information

Business Geographics makes every effort to ensure that the information and material presented in the Business Geographics Portal is accurate and up to date. However, no representation or warranty, express or implied, is made or given about accuracy, completeness or suitability of the information or material for a particular purpose.

The information included on this site does not purport to be a complete database of all information in our possession or control. The Licensee should exercise caution and judgement in the use of any content. Business Geographics will not be liable for any loss or damage which may arise including, without limitation, indirect or consequential loss or damage, or any loss or damages whatsoever arising from the reliance upon or use of any information provided, or information that we have failed to provide.

Early Cancellation Policy

This policy outlines the terms for early cancellation of your Qikmaps subscription. Please read it carefully.

1. Casual Access and Ongoing Subscriptions

   Qikmaps, Qikreports, and access to other portal content can be purchased via either a one-time purchase (casual access), or via an ongoing subscription. One-time purchases grant access to the portal for a fixed period, after which access is revoked. Subscriptions grant access to the portal on an ongoing basis, until the subscription is cancelled. Subscriptions are subject to a minimum term, and can be paid either up-front, or on a monthly basis.

2. Subscription Term

   For ongoing subscriptions, your initial Qikmaps subscription is for a fixed term of twelve (12) months. You have the option to pay for this term annually in advance or on a monthly basis.

3. Subscription Cancellation During the Initial 12-Month Term

   For subscription payments, if you choose to cancel your subscription before the completion of the initial twelve (12) month term, the following conditions apply:
   • Your subscription will be terminated upon our processing of your cancellation request. You can continue accessing the portal until the end of your current billing cycle. For monthly payments, this is one month after your most recent payment date. For annual payments, this is twelve (12) months after your most recent payment date.
   • For monthly payments, an early cancellation fee will be applied. This fee is equivalent to one (1) month's subscription at your current rate.
   • No refunds will be issued for any unused portion of a pre-paid annual subscription.

4. Cancellation After the Initial 12-Month Term (Monthly Payments)

   If you are on a monthly payment plan and have completed your initial twelve (12) month subscription term, you may cancel your subscription at any time. Your subscription will end at the conclusion of your current billing month. No refund will be payable for any part of the current month's subscription if you cancel mid-month.
